Acquisition Information

These original volumes came to the Library of Virginia in a transfer of court papers from Westmoreland County.

Reel 74 was generated by the Genealogical Society of Utah while filming in the Westmoreland County Circuit Court Clerk's Office.

Reel 133 was generated by Backstage Library Works through the Library of Virginia's Circuit Court Records Preservation Program.

Items in Folder 1043058 came to the Virginia State Library and Archives (now the Library of Virginia) under accession number 30143.

Historical Information

Westmoreland County was formed from Northumberland County in 1653, and part of King George County was exchanged with Westmoreland in 1778. The county was named for the English county.

Prior to 1853, when the Commonwealth began recording vital statistics, Virginia marriages were recorded at the county or city level. Beginning in 1661, in order to be married by license, the groom was required to go before the county clerk and give bond with security that there was no lawful reason to prevent the marriage. The license, issued then by the clerk, was given to the minister who performed the service. Written consent from a parent or guardian was needed for individuals younger than twenty-one years.

Until 1780, marriages could be performed only by ministers of the Established Church, who were required by law to record marriages in the parish register. In 1780, dissenting ministers (only four per county from each sect) were first permitted to perform marriage ceremonies. In order to have a record of all marriages, ministers were required to sign a certificate to be filed with the county clerk. The signed document certified that a minister had performed the actual marriage ceremony between the named individuals on a certain date. Intially, ministers sent marriage certificates to the clerk every three months. Some ministers adopted a custom of making collected returns - a list of marriages performed within a period of time such as a year or several years. Beginning in 1784, marriage certificates were returned annually. The law was rarely enforced, and ministers' returns were sometimes late, incorrect, incomplete, and in many instances, not made at all. County clerks compiled a register of marriages based, in part, on ministers' returns.

The original ministers' returns, marriage licenses and marriage certificates, from which these volumes were compiled, were created by the County Court until 1904. After this date, marriages were recorded in the Circuit Court.

Many loose papers were burned during both the Revolutionary War and the Civil War. Volumes that record deeds, court orders except for an order book for the period 1764-1776, and wills exist.

Scope and Content

Westmoreland County (Va.) Record of Ministers' Returns, 1826-1850, notes the returns made by individual ministers of marriages performed within the county in the nineteenth century. The majority of these returns are in the form of lists which record the date of marriage and the names of both parties. In the process of preparing and sending the returns, the name of the minister and the minister's denomination are also recorded. Only pages 1-9 of the volume are numbered. There is a partial index in the front of the volume which is arranged alphabetically (A-Y) by the groom's surname as it appears in the volume. This volume is found on Microfilm Reel 74.

Westmoreland County (Va.) Register of Marriage Licenses with Marriage Certificates, 1850-1919 (pages 1-281), records the marriage licenses issued by the clerk of the County Court. This register includes the date of the license, the name of the male to be married and the name of the female to be married. The register occupies one page of the volume while the corresponding marriage certificates are found on the next page. The pages alternate until the end of 1853. At this time, the certificates were recorded in Marriage Register, 1853-1908. These certficates were part of the ministers' return process. Additional marriage certificates are found for 1855 (p. 52) and 1856 (p. 54). While this volume primarily notes marriages between whites, colored marriages in 1853 and 1854 appear on pages 38 and 45. Loose register pages recording marriages in 1919-1920 (pages 282-286) are found in the rear of the volume. An internal index (A-Z, pages 1-52) is also found at the rear of the volume. The index is arranged alphabetically by the groom's surname as it appears in the volume. Pages 54-62 (B-W) are continuations of this alphabetical arrangement. A blank form for a marriage certificate (1861) and a marriage license (1858) are glued in the rear of the volume. This volume is found on Microfilm Reel 133.
